Seasonal Forever pvt limited ("SFPL") is the licensed owner of the brand Seasonal Forever and the website sfomart.com (”The Site”) . As a visitor to the Site/ Customer you are advised to please read the Term & Conditions carefully. By accessing the services provided by the Site you agree to the terms provided in this Terms & Conditions document.

Personal Information

As part of the registration process on the Site, SFPL may collect the following personally identifiable information about you: Name including first and last name, alternate email address, mobile phone number and contact details, Postal code, Demographic profile (like your age, gender, occupation, education, address etc.) and information about the pages on the site you visit/access, the links you click on the site, the number of times you access the page and any such browsing information.

Eligibility

Services of the Site would be available to only select geographies in India. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Site. Account & Registration Obligations

All shoppers have to register and login for placing orders on the Site. You have to keep your account and registration details current and correct for communications related to your purchases from the site. By agreeing to the terms and conditions, the shopper agrees to receive promotional communication and newsletters upon registration. The customer can opt out either by unsubscribing in "My Account" or by contacting the customer service.

Pricing

All the products listed on the Site will be sold at the price it may deem fit according to the market. The prices mentioned at the time of ordering will be the prices charged on the date of the delivery. Although prices of most of the products do not fluctuate on a daily basis but some of the commodities and fresh food prices do change on a daily basis. In case the prices are higher or lower on the date of delivery no additional charges will be collected or refunded as the case may be at the time of the delivery of the order.

SFPL is the licensed owner of the brand Seasonal Forever and the website sfomart.com (”The Site”) . SFPL respects your privacy. This Privacy Policy provides succinct details about how your data is collected and used by SFPL on the Site. As a visitor to the Site/ Customer, you are advised to please read the Privacy Policy carefully. By accessing the service provided by the Site you agree to the collection and use of your data by SFPL in the manner provided in this Privacy Policy.

We have made every effort to display the colours of our products that appear on the Website as accurately as possible. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will be accurate.

Governing Law and Jurisdiction

This User Agreement shall be construed in accordance with the applicable laws of India. The Courts at Bangalore shall have exclusive jurisdiction in any proceedings arising out of this agreement. Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by SFPL and his decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time. The arbitration shall be held in Bangalore and arbitrator shall be decided by SFPL. The High Court of judicature at Bangalore alone shall have the jurisdiction and the Laws of India shall apply.

Reviews, Feedback, Submissions

All reviews, comments, feedback, postcards, suggestions, ideas, and other submissions disclosed, submitted or offered to the Site on or by this Site or otherwise disclosed, submitted or offered in connection with your use of this Site (collectively, the "Comments") shall be and remain the property of SFPL. Such disclosure, submission or offer of any Comments shall constitute an assignment to SFPL of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the Comments. This clause shall survive the expiry or termination of this User Agreement.

Termination

This User Agreement is effective unless and until terminated by either you or SFPL. You may terminate this User Agreement at any time, provided that you discontinue any further use of this Site. SFPL may terminate this User Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Site, Such termination will be without any liability to SFPL. Upon any termination of the User Agreement by either you or SFPL, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under the User Agreement or otherwise. SFPL's right to any Comments shall survive any termination of this User Agreement. Any such termination of the User Agreement shall not cancel your obligation to pay for the product already ordered from the Website or affect any liability that may have arisen under the User Agreement.

Cancellation Policy

• Any cancellations to the order shall be made before the order is sent for shipping, to claim refund of the paid amount. No refund shall be made once the product is being shipped.
• Cancellation of order shall be made with mail with Subject:” Cancellation Request” and sent to sfoblr@gmail.com

• Cancellation shall be initiated after formal order cancellation request is received at sfoblr@gmail.com. And amount will be credited in the same account from where it’s deducted within 7 to 10 days.
• In case of Cancellation, bank transaction charge will be applicable and paid by customer.

Refund policy

• Refund shall be made under following conditions:
• Order was cancelled. 
• Order was not delivered to the recipient. (This does not include the case for unfounded recipient) 
• If there is any complaint regarding the quality of the product being delivered, we will enquire about the same and if it is found to be true, the customer will get a full refund or the product will be replaced. 
• A refund can only be requested in case of service failure, our team will evaluate if an order qualifies for a refund and the decision of our management will be final. The refund amount in no circumstances can exceed the amount paid by customer; we are not liable for any loss or claim beyond the amount actually paid by customer.
• Any discounted or exempted amount cannot be claimed for refund.
• Any extra amount credited to seasonal forever account may be considered for order enhancement but will not be refundable.
• In all matters concerning Cancellation and refund Online Delivery shall have the deciding hand.
• Online Delivery may amend its Cancellation and Refund Policy from time to time. If we make any substantial changes in the way we use your personal information we will notify you by email or an announcement on the website.

Return policy

It is understood between seasonal forever that returns be accepted and calculated within select parameters

• Any returns due to default of the company of damaged product or bad product quality will be taken into the consideration.
• However seasonal forever will enquire about this and take action against it.

• Shipping cost for return product should be borne by the customer at their own risk. 

Shipping Policy

• Delivery periods quoted at the time of ordering are approximate only and may vary. Goods will be delivered to the address designated by customers at the time of ordering.
• In the case delivery is done by sfomart.com or a third party delivery partner assigned by sfomart.com, we will give great care to deliver in a timely manner. No responsibility is taken for late delivery by sfomart.com in either case.
• All orders are delivered by a reputable courier. We and the Participating vendor will make every effort to deliver within the time stated; however, we will not be liable for any loss caused to you by ordering late. If the Goods are not delivered within the estimated delivery time quoted by us, please contact the participating vendor first. You may also contact us by telephone or email and we will try to ensure that you receive your order as quickly as possible. 
• In case of a late delivery, the delivery charge will neither be voided nor refunded by sfomart.com 
• All risk in the Goods and the Food Delivery shall pass to customers upon 
• If you fail to accept delivery of Food Delivery and/or Goods at the time they are ready for delivery, or we are unable to deliver at the nominated time due to your failure to provide appropriate instructions, or authorizations, then such goods shall be deemed to have been delivered to you and all risk and responsibility in relation to such goods shall pass to you. Any storage, insurance and other costs which we incur as a result of the inability to deliver shall be your responsibility and you shall indemnify us in full for such cost. 
• You must ensure that at the time of delivery of Food Delivery and/or Goods adequate arrangements, including access where necessary, are in place for the safe delivery of such goods. We cannot be held liable for any damage, cost or expense incurred to such goods or premises where this arises as a result of a failure to provide adequate access or arrangements for delivery.
